Read this first. Klooz sends you to real places in the real world. You walk, travel, and follow instructions written by other people. Roads, water, weather, terrain, darkness, traffic and other people are all real, and none of them are under our control. You are responsible for your own safety at every moment. If something looks unsafe, stop. No activity on Klooz is worth an injury.


1. Who you are contracting with

The Klooz platform is operated by:

Referred to below as "Klooz", "we" or "us". You are "you" or "the player".

Drafting note. If the business is transferred to a company (Kft. or Zrt.), these Terms must be reissued with the company as the contracting party, the new registration details, and a new policy_id. A change of contracting party is a material change requiring fresh acceptance.

2. What these Terms cover

These Terms are the contract between you and Klooz for your use of the Klooz platform as a player: the mobile app, the player website, and the services behind them.

They form a contract when you create a player account and accept them. We record which version you accepted and when.

Also part of your contract with us:

  • the Acceptable Use Policy: what content and behaviour are allowed;
  • the Privacy Policy: what personal data we handle and why;
  • the Cookie Policy: what we store on your device.

If these Terms and one of those documents conflict, these Terms govern, except on data protection, where the Privacy Policy governs.

Drafting note. The Privacy Policy is drafted but cannot be published until the deletion, export and retention machinery it describes exists. See the README's launch-blocker list. GDPR applies from the first real user whether or not money changes hands.

3. What Klooz is, and what it is not

Klooz is a marketplace and a technical platform. Creators (independent people and businesses) design real-world experiences: city tours, treasure hunts, outdoor adventures. We host their experiences, let you find them, and give you the app to play them.

We do not design the experiences and we do not run them. We are not the organiser of the activity, not a tour operator, and not a travel agency. We do not walk the routes, inspect the venues, verify that a location is open, safe, accessible, or that the historical claims in an experience are true.

What we do is operate the platform, keep score, coordinate teams, and hold the record of what happened during a session.

The contract for the design and content of an experience is between you and the creator. Our responsibility is described in §9.

4. Your account

4.1 Age

You must be at least 16 years old to hold a Klooz account.

If you are under 18, you may only take part in an activity while accompanied by a responsible adult, and the adult must have accepted these Terms. That adult is responsible for supervising you throughout.

An individual experience may set a higher minimum age. Where it does, that age applies and is shown on the experience page before you book.

We may ask you to confirm your age. If we reasonably believe an account belongs to someone under 16, we will suspend it.

Drafting note. 16 is Hungary's digital-consent age under GDPR Art. 8. Confirm with the lawyer whether a hard 18+ gate should be mandatory for night-time or alcohol-adjacent experiences.

4.2 Registering

You need an account to book or play. You must give accurate information and keep it current. One account per person.

Your account is personal. Do not share your login. You are responsible for everything done through your account unless you tell us it has been compromised.

4.3 Your display name and profile

Your display name is visible to other players in a session and next to any review you write. It must comply with the Acceptable Use Policy.

4.4 Closing your account

You may close your account at any time, from the app or by contacting us. Closure takes effect promptly.

Closing your account:

  • ends any unused ticket or access you hold, unless a refund is separately due under Annex A;
  • does not erase records we are legally required to keep (for example accounting records, or moderation records relating to a report);
  • does not automatically delete everything. What is deleted, what is anonymised and what is retained is set out in the Privacy Policy.

5. Permissions the app asks for

To work, the app needs certain permissions from your device. We ask for each one, we explain why, and you may refuse, but some are required for play to function at all.

Permission Why Refusing means
Location Experiences are triggered by you physically arriving somewhere. We sample your position during a session to check whether you have reached a location, and to record what happened. You cannot play location-triggered experiences. Manual and QR-code fallbacks may be available in some experiences.
Camera Scanning QR codes and barcodes that some experiences use as checkpoints. You cannot complete scan-based tasks.
Notifications Session invitations, teammate activity, and support messages. You will miss time-sensitive prompts. Play still works.
Storage Downloading an offline content pack (the experience, its media and an offline map) so you can play without signal. You cannot play offline.

Location deserves a specific warning. During an active session, the app reads where you are and sends it to us. This is how the platform decides whether you reached a checkpoint, how a teammate sees where you are, and how support can reconstruct a session when something goes wrong.

Location reading runs only while a session is active and stops when the session ends. We keep your latest position for the session rather than a continuous trail of everywhere you went, except when you play offline, where your device records a sequence of positions and uploads it when you reconnect. All of it is deleted 90 days after the session ends.

We process location because delivering the experience requires it, not on the basis of your consent; you cannot play a location-triggered experience without it. The full explanation, the retention periods and how to have your data deleted are in the Privacy Policy.

You can withdraw any of these permissions at any time in your device settings, and change your consent choices in the app's settings.

6. Safety: your responsibility in the real world

This section matters more than any other in this document. Read all of it.

6.1 You decide whether it is safe

You are solely responsible for your own safety and for the safety of anyone in your care. Before and during an activity you must judge for yourself whether it is safe to continue, given the weather, the light, the traffic, the terrain, your physical condition, your equipment and the area.

If in doubt, stop. Abandoning an activity is always the correct choice when you are unsure. No score, ticket, or teammate is a reason to continue into a situation you think is unsafe.

6.2 Rules you must follow

While taking part in an activity you must:

  • obey all traffic laws. Do not look at your phone while crossing a road, cycling or driving. If an experience involves driving, only a passenger may operate the app;
  • respect private property. Do not enter private land, closed premises, or restricted areas. If an instruction seems to send you somewhere you are not allowed to be, stop and report it (§10);
  • obey signs, barriers, closures and the instructions of police, security staff and property owners. They override anything the app tells you;
  • stay out of dangerous places: railway lines, construction sites, tunnels, roofs, waterways, cliffs, and anywhere unlit or unsafe at the time you are there;
  • not trespass, damage, remove or alter anything in the physical world in order to complete a task;
  • not take part while impaired by alcohol, drugs or medication that affects your judgement;
  • look after anyone under 18 in your group, and stay with them;
  • carry what you need: charged phone, water, suitable clothing and footwear, and a way to call for help.

6.3 The app is not a navigation or safety system

Klooz is not a navigation app, not a mapping authority, and not an emergency service. Its maps, distances, times, routes and directions are approximate and may be wrong, out of date, or unsuitable for the way you are travelling. GPS positioning is imprecise, especially between tall buildings and indoors.

In an emergency, call the emergency services (112 in the EU). Do not rely on the app.

6.4 Health

Activities involve walking, sometimes for hours, sometimes over uneven ground, sometimes at night. Some require a level of physical fitness. You are responsible for judging whether an activity suits your health, fitness and abilities, and for consulting a doctor if unsure.

Where an experience states accessibility information, that information comes from the creator and we have not verified it.

6.5 Other people

You are responsible for how you behave towards other players, towards people at the locations you visit, and towards property. The Acceptable Use Policy applies in the physical world exactly as it does in the app.

7. Booking and access: pilot period

During the pilot period, Klooz is free and invitation-only. Access is granted by invitation or a redemption code, no fee is charged, and no payment details are collected by us.

When you book a free experience, you get the right to play a specific published version of it. That right may be limited in how many times it can be used and may have a validity window. Both are shown before you book.

We may withdraw, change or end pilot access at any time, with reasonable notice where practical.

When paid tickets go live, Annex A applies in addition to this section, and you will be asked to accept an updated version of these Terms.

8. During a session

8.1 How progress is decided

Klooz decides progress and scoring on our servers, not on your phone. When you play offline, your device records what you did and uploads it when you reconnect; our servers then replay and validate it. Where the two differ, the server's result is final. This exists to keep play fair for everyone.

8.2 When the real world does not cooperate

Venues close, GPS drifts, QR codes get removed, phones die. Experiences may offer fallbacks (a QR scan, a manual confirmation) and our support team can issue an override to unblock you. Contact support (§13) if you are stuck.

8.3 Teams and hosts

In a team session, one player is the host. The host may assign roles, resolve group decisions and control the session's progress. Other players in the session can see your display name, your progress and, while the session is active, your approximate location. Do not join a team session with people you are not willing to share that with.

8.4 Fair play

Do not cheat: no modifying the app, no faking your location, no scripting, no sharing answers to defeat the experience for others, no using another player's account. We may void a session, remove a score, or suspend an account for this.

8.5 Interruptions

Sessions can be paused and resumed, and you can rejoin after losing connection. We do not promise that any session will run without interruption. Technical faults, connectivity, device failure and battery are risks you accept when taking part.

9. Our responsibilities and our limits

9.1 What we promise

We will provide the platform with reasonable skill and care. Where a service we provide is defective, your statutory rights as a consumer under Hungarian law apply, and nothing in these Terms limits them.

9.2 What we do not promise

We do not promise that the platform will be uninterrupted or error-free, that an experience is accurate, that a location is open or accessible, or that a route is safe.

9.3 Creator content

Experiences are created by creators, not by us. We do not systematically check them before publication. We are not responsible for the content of an experience, for its factual accuracy, for the state of the places it sends you to, or for anything a creator promises you outside the platform.

We do act on reports (§10 and the Acceptable Use Policy).

9.4 Limits on our liability

We do not limit or exclude our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Hungarian law. Nothing in this section takes away your statutory consumer rights.

Within those limits:

  • we are not liable for loss or damage arising from your own decisions in the physical world, from your failure to follow §6, or from the acts of other players or third parties;
  • we are not liable for indirect or consequential loss, lost profit, lost data or lost opportunity;
  • where we are liable, our total liability to you in connection with a given experience is limited to the greater of the amount you paid for it and [AMOUNT] EUR.

Drafting note. The cap must be reviewed. A cap this shape is standard for digital services but its enforceability against a consumer, in a product with physical-injury exposure, is exactly what the lawyer must rule on. See README open question 2.

9.5 Insurance

Klooz does not insure you. Check whether your own health, travel or accident insurance covers the activity you are about to do.

10. Reporting problems and illegal content

If you find content on Klooz that is illegal, unsafe or breaches the Acceptable Use Policy (including an experience that sends players somewhere dangerous or private) report it. Every experience and review has a report control, and you can email [ABUSE EMAIL].

How we handle reports, what we tell you, and how to challenge a decision is set out in the Acceptable Use Policy.

If you are hurt or in danger, contact the emergency services first.

11. Reviews and content you write

You may review an experience you have actually played. Reviews must be honest, your own experience, and compliant with the Acceptable Use Policy. Do not include other people's personal data or photographs of identifiable people without their consent.

You keep ownership of what you write. You give us a non-exclusive, worldwide, royalty-free licence to host, display, translate and distribute it on and about the platform, for as long as you leave it published, and to keep an internal record afterwards for moderation and audit purposes.

We may hide or remove a review that breaches these Terms or the Acceptable Use Policy. We keep the audit trail; removal from public view is not deletion from our records.

12. Suspension and termination

You may stop using Klooz and close your account at any time (§4.4).

We may suspend or terminate your access if:

  • you materially breach these Terms or the Acceptable Use Policy;
  • you behave in a way that endangers yourself or others;
  • we are required to by law;
  • we discontinue the service.

Except where the breach is serious, illegal, or repeated, we will tell you why and give you a chance to put it right. Where we suspend or terminate, we will give you a statement of reasons and tell you how to challenge it, as described in the Acceptable Use Policy.

If we terminate for a reason that is not your fault (for example we discontinue the service) we will refund any unused paid access, once Annex A is in effect.

13. Support and complaints

If you are a consumer and we cannot resolve your complaint:

  • you may contact the conciliation board (békéltető testület) attached to the county chamber of commerce for our registered seat: [BOARD NAME AND ADDRESS];
  • you may contact the consumer protection authority: [AUTHORITY];
  • you may bring proceedings in the courts as described in §16.

Drafting note. The EU ODR platform was shut down on 20 July 2025. Do not reference it. Confirm the current Hungarian conciliation-board designation and whether a general obligation to state one applies.

14. Changes to these Terms

We may change these Terms. If a change is material, we will tell you at least 30 days before it takes effect, by email or in the app, and ask you to accept the new version. If you do not accept, you may close your account; the old version continues to apply to any access you already hold until it expires.

Changes required by law may take effect sooner where the law requires it.

Each version has a policy_id. We record which one you accepted.

15. Other terms

Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, on notice to you, provided your rights are not reduced.

Severability. If a provision is unenforceable, the rest stands.

No waiver. If we do not enforce something immediately, we do not lose the right to enforce it later.

Entire agreement. These Terms, the Acceptable Use Policy, the Privacy Policy and the Cookie Policy are the whole agreement between us about the platform.

Language. These Terms are published in English. Where a translation is provided and there is a conflict, [the [LANGUAGE] version governs for consumers resident in [COUNTRY]].

16. Governing law and jurisdiction

These Terms are governed by Hungarian law, in particular Act V of 2013 on the Civil Code.

If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you habitually live, and you may bring proceedings in the courts of that country. We will bring any proceedings against a consumer in the courts of the country where the consumer lives.

If you are not a consumer, the courts of Hungary have exclusive jurisdiction.


Annex A: Tickets, payment and cancellation (not yet in effect)

This annex does not apply during the pilot. It takes effect only on the date paid tickets go live, which will be announced with an updated version of these Terms. It is published now so the framework is visible, and because the refund mechanism it describes does not yet exist in the platform. Do not switch this annex on before it does.

A1. What a ticket is

A ticket is the right to play one specific published version of an experience. It carries:

  • a replay policy: how many times it may be used;
  • an optional validity window: the period during which it may be used.

Both are shown before you buy. A ticket is personal to you and cannot be resold or transferred.

A published version is immutable. If the creator later changes the experience, your ticket still gives you the version you bought.

A2. Price and payment

Prices are shown inclusive of applicable tax. Payment is processed by Stripe Payments Europe, Ltd.; we do not receive or store your card details.

We sell the ticket in our own name. Your contract for the ticket is with us.

Drafting note. Whether Klooz sells in its own name or as agent for the creator decides VAT treatment, who owes a refund and who a consumer sues. This draft assumes own-name sale, matching the code. It is a decision, not a fact. See README open question 4.

VAT on a real-world activity is generally due where the activity happens, not where the buyer lives. The tax shown at checkout reflects that. Do not enable automatic digital-goods tax logic without checking this; it breaks both the tax treatment and ticket fulfilment.

A3. Your right of withdrawal

Under Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between a consumer and a business, a consumer generally has 14 days to withdraw from a distance contract without giving a reason.

Two exceptions in that decree apply to Klooz, and you should read both:

A3.1 Activities tied to a specific date. The right of withdrawal does not apply to a contract for a leisure service where the contract provides for a specific date or period of performance. If you book an experience for a fixed date or time slot, you cannot withdraw. Where this applies, it is stated clearly before you book, and the cancellation terms in A4 apply instead.

A3.2 Services fully performed. Where you ask us to start performance before the withdrawal period ends, and you expressly acknowledge that you will lose the right of withdrawal once the service has been fully performed, then starting to play the experience ends your right of withdrawal. We ask for that acknowledgement explicitly at the point you start a session.

Where neither exception applies (for example an undated ticket you have not started) you have 14 days from purchase to withdraw. Tell us by any clear statement, including the withdrawal form at [URL] or by email to [SUPPORT EMAIL]. We refund within 14 days of receiving your notice, by the payment method you used.

A4. Cancellation and refunds outside the withdrawal right

To be completed. The refund window, any fee, weather cancellations, creator cancellations, no-shows, and technical failures are a business decision that has not been made, and the refund machinery does not exist in code. This section must be written and the code built before any ticket is sold.

At minimum this section must state: how to cancel; the deadline; whether a fee applies; what happens if the creator cancels; what happens if the platform fails technically; how long a refund takes; and (critically) that a refund revokes the ticket.

A5. If something goes wrong with a paid experience

If an experience is materially not as described, or cannot be played for reasons attributable to us or the creator, contact support. Your statutory rights to a remedy under Hungarian consumer law apply and are not limited by these Terms.

A6. Currency

Prices are in EUR unless stated otherwise.

Drafting note. The platform's minor-unit conversion assumes two decimal places. Zero-decimal currencies would be charged 100× the intended amount. Do not offer a non-EUR currency until this is fixed.
