Acceptable Use Policy
Draft. Not in force. Not legal advice.
This policy applies to everyone on Klooz and forms part of both the Player Terms and the Creator Terms.
It covers two things people often keep separate: what you may publish and how you must behave in the real world. On Klooz they are the same problem. An experience is not just text; it is an instruction that sends a person to a physical place. Content rules that stop at the screen would miss the actual risk.
1. The short version
Do not publish anything illegal, harmful, or that you do not have the rights to. Do not send players anywhere they are not allowed to be or would not be safe. Do not harass anyone. Do not cheat. Do not put minors at risk.
If you see something that breaks these rules, report it (§6). We read every report.
2. Content that is never allowed
You may not publish, upload, transmit or link to content that:
Is illegal
- child sexual abuse material, reported to the authorities without exception;
- terrorist content, or material inciting or glorifying violence;
- content inciting hatred or violence against a group or person on grounds of race, ethnic origin, nationality, religion, disability, age, sex, sexual orientation or gender identity;
- content facilitating a crime, including instructions for weapons, explosives or drugs;
- material that infringes someone else's intellectual property;
- content that breaches data protection law, including publishing someone's personal data without a lawful basis.
Harms people
- threats, harassment, bullying, stalking, or content designed to intimidate;
- sexual content involving minors, or sexualised depiction of minors in any form;
- pornography or gratuitous sexual content;
- content promoting self-harm, suicide or eating disorders;
- doxxing, publishing someone's home address, workplace, phone number or movements;
- impersonation of a person, business or public authority.
Deceives
- false claims about an experience, its content, its length, its difficulty or its accessibility;
- fake reviews, ratings bought or exchanged, or coordinated manipulation of rankings;
- scams, phishing, or anything asking players for payment, passwords or personal data outside the platform;
- malware, or links to it.
Is not yours
- text, images, audio, video, maps or trademarks you do not have the rights to distribute commercially.
3. Rules for designing an experience
These apply specifically to creators, and are the real-world half of this policy. The Creator Terms §5 state them as contractual warranties; here they are as rules.
3.1 Never send players somewhere they may not go
No experience may direct a player onto private land, into closed premises, or into a restricted area without the owner's permission. If a location needs permission, get it before you publish.
3.2 Never require a dangerous act
An experience must not require, encourage or reward:
- crossing roads or railway lines away from a designated crossing;
- entering water, tunnels, construction sites, derelict buildings, or climbing anything;
- entering an area that is unlit, isolated or unsafe at the hour the experience is designed for;
- interacting with traffic, machinery, animals or strangers in a way that creates risk;
- damaging, defacing, removing or hiding anything in the physical world;
- consuming alcohol or any substance as a task;
- rushing, racing, or beating a clock in a way that pressures players near traffic or on difficult ground.
Timed elements are allowed. Timed elements that reward hurrying across a road are not.
3.3 Say what the activity actually involves
The listing must state hazards, terrain, total distance, expected duration, minimum age, anything a player needs to bring, and whether it suits children, wheelchairs or limited mobility. Accessibility claims must be true. A player deciding they can take part relies on them.
3.4 Keep it current
If a venue closes, a route becomes unsafe, or a checkpoint disappears, update or unpublish the experience promptly. A stale experience that strands players in the field is a breach of this policy, not just poor maintenance.
3.5 Respect the places you use
Do not design experiences that create nuisance, noise, crowding or disruption for residents, businesses, staff or worshippers at the locations you use. Do not use places of mourning, memorials, hospitals, schools or private homes as puzzle targets.
4. Rules for behaviour
These apply to everyone, in the app and at the location.
Towards other players
- no harassment, threats, slurs, sexual harassment or discriminatory abuse in chat, display names, reviews or in person;
- respect the decision of any teammate to stop or leave;
- do not share another player's location, photos or personal details outside the session.
Towards other people
- follow the instructions of police, security staff, property owners and venue staff; they override anything the app says;
- do not photograph or film identifiable people without their consent;
- do not disturb, obstruct or pressure anyone at a location in order to complete a task.
Towards the platform
- one account per person; do not use someone else's;
- no faking your location, modifying the app, automating play, or otherwise defeating the platform's checks;
- no scraping, bulk downloading, or reverse engineering beyond what the law permits;
- no probing or attacking the platform's security. Report vulnerabilities to [SECURITY EMAIL]; we will not pursue good-faith research reported responsibly;
- no reselling tickets or access.
Minors
- players under 18 take part accompanied by a responsible adult;
- do not design or run experiences that put minors in unsupervised contact with adults they do not know;
- if you believe a minor is at risk, report it immediately and contact the authorities.
5. Reviews
Review only what you actually played. Be honest. Do not review your own experience, arrange reviews, or use reviews to threaten a creator. Do not include other people's personal data.
6. Reporting illegal content and breaches
This section is our notice-and-action mechanism under Article 16 of Regulation (EU) 2022/2065 (the Digital Services Act).
Anyone (user or not) may notify us of content on Klooz they consider illegal.
6.1 How to report
- use the report control on an experience, review or player profile in the app; or
- email [ABUSE EMAIL].
Please include, as far as you can:
- why you believe the content is illegal or breaches this policy;
- where it is, the experience, review, listing or profile, with a link or identifier;
- your name and email, so we can confirm and follow up. This is not required for reports about child sexual abuse material or content of the kind covered by Articles 3–7 of Directive 2011/93/EU;
- a statement that you believe, in good faith, that the information is accurate and complete.
A report containing all of the above is treated as giving us actual knowledge of the content.
If someone is in immediate danger, contact the emergency services first.
6.2 What we do
- we confirm receipt without undue delay;
- we assess the report in a timely, diligent, non-arbitrary and objective way;
- where we use automated means at any stage, we say so;
- we tell you the outcome and the reasons for it, and the routes to challenge the decision.
6.3 What we may do about the content
Proportionate to the breach, and taking account of whether it is a first or repeated one:
- take no action;
- ask the creator or user to fix it within a stated time;
- hide, unlist or remove the content;
- suspend a listing, a session or an account;
- terminate an account;
- report the matter to law enforcement.
We act immediately, without prior warning, where there is a risk of physical harm to players or the public, where the content is manifestly illegal, or where the law requires it.
6.4 Statement of reasons
Where we restrict content or an account, we give the affected user a statement of reasons on a durable medium, covering: what we did and its scope, the facts and circumstances we relied on, whether automated means were used, the ground (the legal basis or the clause of this policy) and how to challenge it.
We do not do this where the content is deceptive commercial content published in bad faith at volume, or where the law forbids telling the user.
6.5 Challenging a decision
If you disagree with a decision (as the person who published the content, or as the person who reported it) write to [APPEALS EMAIL] within [N] days, saying why. A person who was not involved in the original decision reviews it, and we reverse it without delay if it was wrong. We tell you the outcome and the reasons.
You may also take a dispute to a court, and to any out-of-court dispute settlement body certified under Article 21 of the Digital Services Act.
6.6 Misuse
We may suspend, after warning, users who repeatedly publish manifestly illegal content, and users who repeatedly submit manifestly unfounded reports.
6.7 Point of contact
Contact point for authorities and for notices under the Digital Services Act: [DSA CONTACT EMAIL]. Language of communication: English and Hungarian.
Drafting note. Article 19 of the DSA excludes micro and small enterprises from most of Section 3: no transparency reports, no trusted flaggers under Art. 22, no Art. 20 internal complaint system as a formal obligation, and no monthly active-user publication. Article 16 (this section) still binds you. The appeal route in §6.5 is offered voluntarily, not because Art. 20 requires it; it is also close to what the platform's existing moderation and appeals APIs already do. Confirm the exemption still holds when headcount or turnover changes, and confirm whether Klooz is a "hosting service" or an "online platform" for these purposes; it looks like the latter.
7. Enforcement
Enforcement is proportionate. A first, minor, fixable breach normally gets a warning and a chance to correct. Serious breaches (danger to players, illegal content, fraud, harm to minors) get immediate action.
Every enforcement action is recorded with who took it, why, and when. Creator-side notice periods and appeal rights are in Creator Terms §9; player-side in Player Terms §12.
8. Changes
We may update this policy. Material changes are notified as described in the Player and Creator Terms, including the 15-day notice creators are entitled to. Each version has a policy_id.
